Darcy Kriha is an equity partner in the Chicago-based education law firm Franczek Radelet. She represents public school districts and special education cooperatives throughout Illinois. In addition to overall school board representation, Darcy has extensive experience handling special education and high-pro le student discipline matters. In July 2006, Darcy was selected by the Law Bulletin Publishing Company as one of Illinois’ “40 Under 40 Attorneys to Watch.”  Darcy joined Franczek Sullivan P.C. in 1997. She received her law degree in 1992 from the John Marshall Law School and graduated magna cum laude from Mundelein College in 1989 with a Bachelor of Arts degree in Psychology. She is a member of the Bar of the State of Illinois and is admitted as an attorney of record before the United States Supreme Court, the Illinois Supreme Court, the United States Court of Appeals for the Seventh Circuit, and the United States District Courts for the Northern and Central Districts of Illinois, including the Northern District Trial Bar.

Amy Dickerson represents educational institutions, including public school districts, charter schools, private schools, and higher education institutions, in a variety of education law matters. Amy counsels clients in labor and employment, special education, student rights, student discipline, Title IX investigations, and policy and governance issues. She regularly represents clients in individual educational program (IEP) meetings, due process matters, local and state administrative proceedings on employee and student matters, state and federal court litigation, and before the U.S. Department of Education Office for Civil Rights. Amy also regularly assists clients with teacher evaluation, discipline and dismissal issues.

Amy is recognized by Illinois Super Lawyers as a Rising Star in Schools and Education Law (2012-2015). Amy is an active member of the Illinois Council of School Attorneys and the National Council of School Attorneys and frequently speaks on education law topics at Illinois State Bar Association events. She is also a member of the American, Illinois State, and Chicago Bar Associations.

Over the years there has been several legislative actions taken in both Illinois and our federal government designed to protect student privacy.  With new technology and internet access these student privacy issues have expanded into new laws.  In addition, recent court rulings have also affected the protections afforded to student privacy.  Two legislative acts in particular provide guidance on these issues.   The Family and Educational Rights Privacy Act (FERPA) FERPA allows parents to have rights to their child’s education records and works to protect student privacy.  The Illinois School Student Records Act (ISSRA) protects the rights of students and parents to obtain student educational records, both temporary and  permanent.  In accordance with FERPA and ISSRA, security protocols should be in place to protect student privacy not only under the current school district administrations, but future administrations as well.

This Legal Seminar is designed to provide educators with the latest information and guidance available so that educators know the “Do’s’ and ‘Don’ts” one must follow.
